2023 Presidency: Ex-President Jonathan Constitutionally Qualified To Run For Only One Term – Lawyer

Abdul Aminu Mahmud, a Nigerian lawyer, and social critic has said former President Goodluck Jonathan is eligible to contest the 2023 presidential election.
 
The lawyer said this in a statement on Friday.

According to the former students’ leader, Jonathan only served a term of four years from 2011 to 2015 while the one year of the late Umaru Yar'Adua, which he completed as Acting President doesn't count as part of his presidential term.
 
He added that different courts have, over the years, declared retroactive application of laws as reprehensive and abusive, stressing that the provisions of Section 137(3) of the 1999 constitution were not and would not present an exception simply because some persons desire it to be so.
 
“A lot has been made of Section 137 (3) of the Constitution 1999 (With Alterations). As far as I am aware, the arguments that Dr Jonathan is not constitutionally qualified to seek the presidential office were first canvassed by my friend and former undergraduate classmate, Dr Law Mefor, in November 2020. Just yesterday, my friend and comrade, Femi Falana (SAN), canvassed the same arguments. I don't agree with them,” he said.
 
“With respect to Section 137(3) CFRN 1999, statutes are construed as operating only in cases or on facts which came into existence after the statutes were passed unless a retroactive effect is intended. Section 137(3) is not in any way retroactive or retrospective, nor is it intended to be so (The SC decisions of Obayemi v PDP (2019), Gusau v APC (2019) & Kusamotu v APC (2019 were held for a different reason - computation of time ) - it is prospective because it deals with substantive rights, not time computation or the extinguishment of the procedure.
 
“The Supreme Court clarified retroactive and prospective statutes in Ojokolobo v Alamu (1998) and I'm of the view that this decision would help us to correctly interpret Section 137(3), without importing absurdity to the intention of the drafters.
 
“This is what the Supreme Court held: ‘It is a cardinal principle of our law that a statute operates prospectively and cannot apply retrospectively unless it is made to do so by clear and express terms or it only affects purely procedural matters and does not affect the rights of the parties: Oshinye v. Commissioner of Police 5 FSC 105 at 112, Kimbray v. Draper (1868) L.R. 3 QR. 160 at 163, In re Suche & Co. Ltd. (1875) 1 Ch. 48 at 50, Colonial Sugar Refining Co. v. Irving (1905) A. C. 369 at 172.
 
“The Supreme Court further clarified in Ojokolobo's case that ‘Generally, statutes are construed as operating only in cases or on facts which come into existence after the statutes were passed unless a retrospective effect is clearly intended’.
 
“It is a fundamental rule of Nigerian law (received from English law) that no statute shall be construed to have a retrospective operation unless such a construction appears very clearly in the terms of the Act or Law, or arises by necessary and distinct implication see ‘Re Athlumney (1898) 2 Q.B. 551 at pp. 551. 552’. What do we mean by retrospective operation of a statute? A statute is a retrospective “which takes away or impairs any vested right acquired under existing laws or creates a new obligation or imposes a new duty, or attaches a new disability in respect to transactions or considerations already past.”- Per Obaseki JSC.
 
“What my friends appear to make out is that S.137(3) of the Constitution 1999 is retroactive. The decisions of Obayemi, Gusau and Kusamotu deal with the computation of time to file a pre-election appeal and not substantive rights. Our guide on this issue is Ojokolobo's case.


“My friends’ arguments are an absurd interpretation of Section 137(3) CFRN 1979. Statutes are construed as operating only in cases or on facts which came into existence after the statutes were passed unless a retroactive effect is intended. The retroactive provision of a statute can never extinguish the rights established by a substantive law. A retroactive law can never impair existing rights or obligations, except the right or obligation is of the procedure. Section 137 (3) is thus perspective, to the extent that it takes effect in the future, by affirming the substantive right to seek elective office.
 
“Furthermore on the question of whether Dr Jonathan can spend more than two terms of eight years of the Presidential terms of office, my answer is that Dr Jonathan previously served a term of four years from 2011-2015. The one year of the late Yar'Adua doesn't count as part of his Presidential term. The Court of Appeal in Cyriakus Njoku v Dr Jonathan and Ors (2015) clarified this point and distinguished it from the Supreme Court decision in Marwa v Nyarko (2012) and held that the one year of Yar'Adua served out by Dr Jonathan doesn't fall within the computational term of four years because Dr Jonathan was appointed by the Constitution (Section 137(1) and (2)) and not elected as President. The Court further held that Dr Jonathan had only previously sworn to one oath of office - Oath as elected Vice President, not President.
 
“I don't support the regressive adventure and morally hollow decision of Dr Jonathan to run for another term, either in APC or whatever party he chooses; my purpose here is to join to give clarity to the law until the court makes a pronouncement on Section 137 (3).”
 
Senior Advocate of Nigeria, Femi Falana had on Wednesday said Jonathan cannot seek re-election into the office of the President according to the constitution.
 
President Muhammadu Buhari had on June 4, 2018, signed a constitutional amendment that stops a Vice President who completes the term of a President from contesting for the office of the President more than one more time.
 
The law also stops a deputy governor who completes the term of a governor from seeking a second term in office as a governor.
 
A President’s term can be cut short by reasons of death, resignation, or death to pave the way for the Vice-President to complete the term of the departed President.
 
Following the death of then-President Umaru Yar’Adua on May 5, 2010, Jonathan as the then Vice-President, took a new oath of office to complete Yar’Adua’s term as President.
 
He was also sworn in for another term on May 29, 2011, after he won the presidential poll of that year.
 
According to Falana, Jonathan is affected by the constitution amendment.

2023 Elections: Buhari Warns International Community Against Interference, Threatens Riggers

President Muhammadu Buhari has warned the international community against interfering with the general elections in 2023.
Buhari asked the global community to avoid asserting negative influences in the coming elections.

He gave the warning at the State House in Abuja during an iftar dinner with members of the Diplomatic Corps.
The President said political temperature is bound to heighten in the run-up to the end of his administration on May 29, but that he was committed to “bequeathing a stronger culture of credible elections to Nigeria than I met”.
‘‘As Nigeria goes through this trajectory, I urge our friends in the global community, represented by you the Diplomatic Corps, to adopt a positive role that reinforces the doctrine of respect for our internal affairs and respect for facts and devoid of preconceived notions and bias,” he added.
Buhari vowed to use every legitimate means to protect Nigerians’ votes during the 2023 general elections.
“Those planning to rig the forthcoming elections should think twice because I intend to resolutely protect and defend the sacred will of the Nigerian people, to be expressed through the ballot box.”
On the Russia-Ukraine conflict, Buhari called for greater consideration for humanitarian conditions in the affected areas, warning that “the conflict will get worse if an immediate resolution is not found”.
“The war has lasted too long; cost so much and hurt too many people well beyond the immediate theatres.
“The rest of the world is progressively facing the impact of the conflict and this will certainly get worse if an immediate resolution is not found, not least in the area of food security,” he said.
He urged the world, especially the Muslim community to use the solemn and rewarding month of Ramadan to intensify prayers for the de-escalation of the conflict and for the return of peace to the world.
On the fight against Boko Haram, Buhari said: “As you know well, Nigeria has made significant progress in combating the Boko Haram group in the Northeast
“We are, however, recently confronted with new tactics deployed by the enemy to threaten our democratic values, as well as the common peace and freedom we enjoy in this country."

Nnamdi Kanu Barely Feeds, His Health Is Deteriorating In Detention — IPOB Leader’s Lawyer

Ifeanyi Ejiofor, the lead counsel for the Indigenous People of Biafra (IPOB) has criticised officials of the Department of State Services (DSS) over their disobedience to court orders.
 
Ejiofor, in a statement issued on Thursday, said the health condition of the IPOB leader, Nnamdi Kanu, is deteriorating in detention as the DSS officials barely feed him.

He added that Kanu had not been allowed to change his clothes despite the pronouncement by Justice Binta Nyako of a Federal High Court in Abuja.
 
He stated, “In line with the court-ordered guideline, we conducted the routine visit to our indefatigable Client - Onyendu Mazi Nnamdi Kanu at the DSS Headquarters today.
 
“Pertinent concerns on legal matters of engaging urgency were frankly discussed with Onyendu, and the outcomes were fruitful.
 
“Onyendu’s continued use of the same clothing is increasingly worrisome as the DSS personnel have blatantly denied him change of clothing in their usual flagrant disobedience of court orders.
 
“Recall that at the last adjourned date, being the 8th day of April, 2022, this issue was raised and the Judge ordered that Onyendu’s clothes should be taken along by the DSS after the proceedings, and should be promptly handed over to him upon their return to the DSS facility.
 
“Unfortunately, it is utterly disheartening to note that up until the time of our visit today, Onyendu has not been handed those clothes for a change.
 
“Despite a clear and unequivocal directive from His Lordship to the DSS' lawyer to ensure that the court order is obeyed, the DSS in their usual style roundly ignored and treated it with the utmost disdain, as they are yet to comply with this recurrent court order, requiring Onyendu’s change of clothing.
 
“We were also, reliably informed by Onyendu that his meals are no longer served regularly. Onyendu barely eats once a day, and this situation is not helping his deteriorating medical condition.
 
“The lawless DSS personnel have remained adamant with the manner in which they treat court orders with levity and disdain, which is totally unacceptable as no one is above the law anywhere in the world.
 
“Be assured UmuChineke that we, in the legal team are not resting on our oars towards ensuring that these infractions are addressed with immediate effect.
 
“Consistent with his nature of gratitude, Onyendu thanks you all, millions of his supporters and Ezigbo UmuChineke for relentlessly standing tall, it is not taken for granted by Onyendu.
 
“Also, Onyendu specifically requested that I inform you all, that you are in his prayers always too. Above all, he requests that you should all be assured that it will end in victory in no distant time.

BREAKING: Nigerian Army Kills ISWAP/Boko Haram Spiritual Leader, 'Several Terrorists' In Borno

The Nigerian Army has said troops of Operation Desert Sanity neutralised several Islamic State West Africa Province (ISWAP) and Boko Haram terrorists in Borno, northeast Nigeria.
It said the troops also killed the Amir (commander) and spiritual head of Galta, close to Mandara Mountain in the South of Borno, during an operation around Manjo Ali Qere in the state.


The army in a post on its official Twitter handle on Friday morning said arms and ammunition were also recovered during the operation.
“Gallant Troops of Operation Desert Sanity neutralized several ISWAP/BokoHaram terrorists including the Amir & spiritual head of Galta during an aggressive clearance operation around Manjo Ali Qere in Borno State on Thur 28 April 2022. Arms & Ammunition were also captured,” the army wrote.
Similarly, the Nigerian Military High Command said its troops had killed a prominent Islamic State of West Africa Province (ISWAP) Commander, Abubakar Dan-Buduma.
According to the military, scores of other terrorists were killed alongside the ISWAP commander.
It also said the troops rescued 848 civilians and arrested 119 terrorists in Northwestern Nigeria in separate operations.
Onyeuko also said a total number of 1,158 terrorists and their families comprising 164 men, 367 women and 627 children surrendered to troops in the last three weeks.

Zenith Bank Plc has announced its unaudited results for the first quarter ended 31st March 2022, with an impeccable growth of 22% in Gross Earnings from N157.3 billion reported in Q1 2021 to N191.5 billion in Q1 2022.  

From the unaudited statement of account presented to the Nigerian Exchange (NGX) on Thursday, 28th April 2022, the strong double-digit growth in the topline culminated in an increase in the bottom line, as the Group recorded an 11% Year-on-Year (YoY) increase in profit before tax, growing from N61.02 billion in Q1 2021 to N67.99 billion in Q1 2022.  

Profit after tax also grew by 10%, from N53.06 billion to N58.19 billion over the same period. The growth in the topline arose from both interest income and non-interest income. Interest income grew by 25%, from N101.12 billion in Q1 2021 to N126.38 billion in Q1 2022, while non-interest income grew by 12%, from N51.20 billion to N57.23 billion. The growth in interest income and non-interest income arose from the combined effects of an improvement in interest income on loans and advances (as risk assets continue to grow and pricing is gradually improving) and an improvement in non-interest income as the Bank continues to deploy its retail strategy, thereby acquiring more customers and expanding its electronic banking income from the increased volume of transactions across all its channels.  

Total assets grew by 9% from N9.45 trillion to N10.32 trillion in 2022, mainly driven by growth in customers’ deposits. Customer deposits grew by 12%, from N6.47 trillion in December 2021 to N7.25 trillion in March 2022. Savings account balance, which is solely retail grew by over N68 billion and is a validation of the robust customer acquisition strategy and versatile electronic platforms and digital channels. 

Loans and advances also grew by 6%, from N3.5 trillion in December 2021 to N3.7 trillion in March 2022, boosting the Group’s interest income and displaying the Group’s appetite for high-yielding risk assets creation. This development also helped to boost the net interest margin (NIM), as it improved from 6.0% in March 2021 to 7.3% in the current period, while the capital adequacy ratio improved slightly from 21.1% to 22.1%. 

Going into the remainder of 2022, the Group will continue to focus on sustainable growth across all its business segments and deploy technology platforms and digital assets intuitively to serve its various customers’ needs to deliver enhanced returns to its stakeholders.

The Evil ASUU Strikes Do, By Oredia Destiny

The ASUU Strike actions has lived rent-free in Nigeria for 34 years. And even till now, we still cannot tell if it would ever be evicted from our midst. What has been the students’ fate even since this industrial struggle began in 1988, if not wasted time and resources, shattered dreams, frustration, drop out, suicide.....e.t.c.?

A government that spends below 10 Percent of the Nation’s GDP on education, should not expect quality results at the end of the day. And when the quality of the education sector is compromised, the future of the Nation is very much at stake. Reason been that, when a child is at a tender stage, he is expected to be adequately nurtured in the wisdom(education) of his country, so that when he is fully grown up, he would begin to apply everything he has learnt for the service of his Nation. But should the education of that young citizen be unfounded and lacking of tangible substance, his country reaps exactly what was sown. As if the mayhems occasioned by poor funding of education was not enough, the government again, has failed Nigerian Students in the area of maintaining cordial relations with ASUU and fulfilling their promises. Thereby bringing the whole system into a stampede.

To make situation worse, the manner at which the FG is going about negotiations with ASUU kills every atom of hope. If the Minister of Education is not walking out of Students, tune in channels TV, his counterpart is there blaming it all on ASUU. Most frustratingly, they pay no respect to the ticking clock even as they make mockery of the lingering strike. At the detriment of who? We the STUDENTS!

ASUU Strike is responsible for over 60 percent of dropout cases in our Universities. Those who held fast to their studies and did not quit, are yet to heal from the bruises they sustained after their passion towards their chosen careers were dashed into utter pieces on the alter of ASUU Strike. The Nigerian Government is indeed hardworking but only when constructing railway to a foreign Land. How about resolving crucial National issues that is directly linked with the future of our dear Country? Overtime, the FG has shown by their actions and inactions, that education is not an utmost priority, hence, their dilly-dallying attitude towards the prolonged strike.

As sophisticated as educational processes are in Europe, the United States, and even in some parts of Asia, the students of those Continents still have their morale boosted by their governments with series of scholarship programs, work-study schemes, grants and so on. Only a pandemic can keep them away from their classes. One does not need a soothsayer to tell what good fortune awaits such Countries.

Dear Federal Government, we are “Students”. We should be in our classes “studying” and not anywhere else. We want to return to where we belong; our lecture halls, hostels, libraries,....e.t.c. It would be to the benefit of Nigeria if this harmless request of ours is granted and the Monster called ASUU Strike is given a permanent eviction letter from our sacred midst.

2023 Presidency: Group Threatens To Sue Jonathan If He Accepts APC’s Invitation, Joins Presidential Race

A group, Igbo Leadership Development Foundation, has threatened to sue former President Goodluck Jonathan who is considering joining the All Progressives Congress to run for President.
Its Vice Chairman/Director of Public Affairs, Dr. Law Mefor told the PUNCH that the group would be going to court to challenge Jonathan should he declare his intention to contest.

According to Mefor, the next President should be from the South-East region.
He argued that Jonathan had been affected by the constitutional amendment and thus had no right to contest.
He said, “I have said it before and I’m saying it again. We will go to court to challenge it if Jonathan joins the presidential race.
“What my group, Igbo Leadership Development Foundation, would test in court is whether Jonathan can be sworn in as President of Nigeria a third time despite the express constitutional provision against it.
“We are just waiting for Jonathan to pick up a political party’s nomination form and the Igbo Leadership Development Foundation will approach a court of competent jurisdiction to challenge his qualification to stand this election. I have nothing personal against Jonathan. After all, I was in his media team in 2015 but we have to do things right as a nation under the law and not as a nation of impunity.”
SaharaReporters had in several reports exposed how a cabal in the ruling All Progressives Congress (APC) had been trying to woo Jonathan to the party and to become its consensus candidate. 
Jonathan’s posters had last week flooded the national secretariat of the APC.
 
Some youth groups also stormed his office in the Maitama area of Abuja, calling on him to join the presidential race.
 
The protesters lamented that since he left office, hunger, insecurity, and unemployment, among others had become the order of the day.
The supporters said that both men and women have turned to beggars because of the unfavourable policies of the present administration.
In his response, the former President said he could not say if he would declare or not but advised his supporters to “watch out”.

“It has been confirmed that former President Goodluck Jonathan has decided to join the All Progressives Congress (APC) with a view to contesting the 2023 presidential election.
“However, the former President is disqualified from contesting the said election by virtue of 137 (3) of the Constitution of the Federal Republic of Nigeria, 1999 as amended which provides as follows: A person who was sworn in to complete the term for which another person was elected as President shall not be elected to such office for more than a single term.”
 
Indeed, the Constitution of the Federal Republic of Nigeria, 1999 (Fourth Alteration, No 16) Act, 2017 says: "The Constitution of the Federal Republic of Nigeria, 1999 (in this Act referred to as “the Principal Act”) is altered as set out in this Act. Section 137 of the Principal Act is altered, by inserting, after subsection (2), a new subsection “(3)”.
“(3)” A person who was sworn in as President to complete the term for which another person was elected as President shall not be elected to such office for more than a single term.”

Tahir Fadlallah, the billionaire owner of Tahir Guest Hotel Kano, is dead.
Garba Shehu, the Senior Special Assistant, Media & Publicity to President Muhammadu Buhari, confirmed the death in a tweet on Friday.

“We have lost Tahir. May Allah grants him Aljannah,” Shehu wrote on Twitter, posting a picture of himself and Tahir.
“The above picture was taken shortly after they released him from hospital after months of treatment in Beirut.”
The billionaire was flown to Beirut, Lebanon for treatment in an air ambulance in May 2020 after he tested positive for Covid-19 in Nigeria.

Troops Killed ISWAP Commander, Dan-Buduma, Over 100 Other Terrorists – Nigerian Military

The Nigerian Military High Command says its troops have killed a prominent Islamic State of West Africa Province (ISWAP) Commander, Abubakar Dan-Buduma.


According to the military, over 85 terrorists were killed alongside the ISWAP commander.

It also said the troops rescued 848 civilians and arrested 119 terrorists in Northwestern Nigeria in separate operations.


Maj.-Gen. Benard Onyeuko, the spokesman for the military, also told journalists in Abuja on Thursday that troops also arrested terrorists’ informants and logistics suppliers between April 7 and 28, 2022.


Onyeuko said 1,158 terrorists and their families comprising 164 men, 367 women and 627 children had surrendered to the military in the last three weeks.


Onyeuko said, “Troops neutralised 23 terrorists, rescued 619 civilians, and arrested 19 terrorists. Troops responded to a distress call of terrorists’ attack at Wanzamai in Tsafe Local Government Area of Zamfara State.
 
“Troops mobilised to the village and engaged the terrorist where scores of the terrorists were killed. In the cause of the operation troops rescued 32 women and 18 children.
 
“Also, within the period under review, troops recovered 592 rustled cattle. Troops also rescued 179 civilians, neutralized 62 terrorists and apprehended 100 terrorists.
 
“The land component of Operation Hadin Kai with support of the air components conducted an offensive operation in Arina Woje in Marte Local Government Area of Borno state and neutralized a prominent Islamic State of West Africa Province Commander Abubakar Dan-Buduma and scores of the terrorists.
 
“Also, a notorious informant and logistic supplier to the Islamic State of West Africa Mallam Abba Sidi Lawan was arrested at Auno town in Konduga Local Government Area of Borno state.
 
“Similarly, troops arrested Abdurrazaq Hudu a logistics supplier of Islamic State of West Africa Province at Mutum Biyu village in Gassol Local Government Area of Taraba state.”

Russian Military Attacks Ukrainian Capital During UN Secretary-General's Visit

The Russian military, on Thursday, hit central Kyiv as the United Nations Secretary-General, Antonio Guterres, was visiting, leaving three injured.
According to the Kyiv mayor, Vitali Klitschko, there had been “two hits in the Shevchenkovsky district”, with one hitting the lower floors of a residential building, AFP reports.


Klitschko said three people had been taken to the hospital, however, he did not give details about the extent of their injuries.
A close aide to the UN chief sent a message to journalists confirming they were safe.
The move prompted a furious response from Ukraine’s government, with foreign minister Dmytro Kuleba denouncing it as a “heinous act of barbarism” which demonstrated Russia’s “attitude towards Ukraine, Europe, and the world.”
Defence Minister Oleksiy Reznikov also lashed out, writing on Twitter, “This is an attack on the security of the Secretary-General and world security.”
The bombardment happened an hour after President Zelenskyy held a news conference with the UN Secretary-General, who said Ukraine has become “an epicentre of unbearable heartache and pain.”
Guterres had visited Putin on Tuesday in order to discuss the urgent need for Russian forces to permit humanitarian corridors for civilian evacuations.
The missile strike can be viewed as Putin's non-diplomatic response to the request.
The irony of the timing was not lost on Mykhaylo Podolyak, a senior Zelensky aide.
“Missile strikes in the downtown of Kyiv during the official visit of @antonioguterres. The day before he was sitting at a long table in the Kremlin, and today explosions are above his head,” he tweeted.
At a press conference just before the missile strikes, Guterres condemned the atrocities committed in towns like Bucha, where evidence of mass killings of civilians was found after Russia retreated in the face of unexpectedly stiff resistance.

Rivers PDP Governorship Aspirant, Dagogo Arrested On Governor Wike’s Order - Aide

Farah Dagogo, the Peoples Democratic Party (PDP) governorship aspirant and federal lawmaker representing Bonny-Degema has been arrested on Thursday.
It was learnt that policemen attached to Government House, Port Harcourt, Rivers State arrested him at the venue of the PDP South-South Zonal office, Port Harcourt, where governorship aspirants were being screened.


The media aide to the Lawmaker, Ibrahim Lawal, in a short statement confirmed the arrest.
“The Federal Lawmaker representing Degema/Bonny Federal Constituency in the House of Representatives and Governorship hopeful of the Peoples Democratic Party (PDP), Hon. Doctor Farah Dagogo has been arrested on the directives of Governor Nyesom Wike at the PDP Zonal Office, the venue for the screening of governorship aspirants.
“Hon. Dagogo was arrested at the governorship screening hall by some police officers and taken to an unknown location,” he said.
Wike had on Wednesday declared Dagogo wanted for allegedly sponsoring cultists to disrupt the PDP secretariat, which was the venue of screening of aspirants.
Wike’s order came barely two days after Dagogo declared his support and allegiance for former Vice President, Atiku Abubakar, to clinch the party’s presidential ticket ahead of the governor.

Angry youths in Namu town, Plateau State, on Thursday attacked Senator Nora Dadu’ut.
Dadu’ut, a member of the All Progressives Congress (APC) represents Plateau South Senatorial District at the National Assembly.


Sources told SaharaReporters that some vehicles in the entourage of the lawmaker including a security vehicle were razed by irate youths who accused her of poor representation and abandoning her constituents.
She was said to be in the town for consultation for her second term ambition.
“Prominent Plateau citizens that attended her programme are still being held hostages by these aggrieved youths as we speak because the security operatives were overwhelmed,” a source said.
Meanwhile, the Quaan Pan Local Government Area authorities have declared a dusk-to-dawn curfew in Namu town and its environs with immediate effect.
Gideon Godenaan Dashe, Secretary of the LGA disclosed this in a statement obtained by SaharaReporters.
The statement read, “Following a review of security breaches in Namu on Thursday April 28, 2022, the Authorities of Quaan Pan Local Government Council of Plateau State, hereby impose a dusk-to-dawn curfew in Namu town and its environs with immediate effect.
“By this announcement, citizens of the area are expected to remain indoors, until further notice while security operatives have been mandated to take charge of the town.
“Citizens are advised to remain law abiding and avoid any action(s) that will cause further breaches.”

Nigerian Police Arrest 21 Suspects Over Murder Of NDLEA Operative In Nasarawa

The police in Nasarawa State have arrested 21 commercial motorcyclists who allegedly killed a National Drug Law Enforcement Agency (NDLEA) officer on April 18 in the Karu area of the state.
The state Commissioner of Police, Adesina Soyemi, paraded the suspects and others on Thursday in Lafia.


The CP recalled that the Divisional Police Officer, New Karu Division, received a distress call at about 9pm on the fateful day.
The DPO was alerted that okada riders attacked the deceased and were about to set his house ablaze.
The DPO, the Anti-Cultism unit and a crack-team led by the Assistant Commissioner of Police (Operations) rushed to the scene at Koroduma, One man village.
On arrival, they found the victim in the pool of his blood and transported him to the hospital where the doctor confirmed him dead.
Soyemi said the manhunt led to the arrest of the 21 persons who allegedly participated in the lynching of the NDLEA personnel.
The police recovered stones, metals and other hard objects used by the suspects to commit the crime.
Soyemi added that they already made useful statements.
The State Criminal Investigation Department, Lafia, will prosecute the case.

Governor Ben Ayade’s Declaration For President Is An Insulting Joke, By Elias Ozikpu

One of the biggest jokes that hit the airwaves this week was that Governor Ben Ayade,
Cross River’s worst governor since 1999, declared his intention to run for President in
2023. This declaration was a cruel insult on the collective intelligence of not just fellow
Cross Riverians, but all Nigerians. It is disrespectful for a governor who has failed so
spectacularly to declare his intention to inject his failure at every level of national life.
Electing Ben Ayade as governor in 2015 was an acceptable mistake, but repeating that
mistake in 2019 was outright foolishness on the part of our people who, despite several
credible warnings, refused to judge the governor on the basis of his catastrophic
performance during the last four years prior to the election.


Without the slightest doubt, Ben Ayade’s declaration for president was partly
programmed as a comic relief in a country burdened with heart-rending daily news of
economic quagmires and rising cases of terrorism that are gradually becoming a norm
in what was supposed to be a civilised society.
What I do know is that this governor has no genuine plan to run for President, and
wouldn’t even win a single ward throughout Nigeria even if he had any intention to
contest the election, with his eight disastrous years in Cross River being a reference
point. But my gripe is that Ayade ought not announce any declaration for President, and
my reason is because he is the first witness of the seven years of spectacular failure he
has supervised in Cross River State. Of course, his praise-singers may be inclined to
argue that the governor has the right to run for any political office he desires. True, but
that right becomes a mirage immediately it is clear that he lacks the capacity and/or
competence to occupy such office.
Ayade’s attention-seeking, risible declaration was a political strategy based on one
weak pillar: to eventually step down to one of his favoured new playmates in the APC
where he sought asylum since May of 2021, and then be rewarded with a ministerial
appointment in the event that dictator Buhari’s “anointed” son emerges victorious in
2023.
Should this crafty, archaic strategy comes to fruition in line with Governor Ben Ayade’s
shabbily written script, Nigerians will certainly not escape the outrageous incompetence
for which the governor’s reign in Cross River is known.
During the past seven years, Ayade has led Cross River State through political
manipulation, deception and dictatorship; all of which he has tried to cover up with his
media razzmatazz. Since 1999, there is no governor who has aggressively
underdeveloped Cross River State like Ben Ayade and none has wasted more funds
than he already has, even when he still has one year to leave office.
Under Ayade’s reign in Cross River State, cultists and kidnappers continue to roam
every inch of the state freely, abducting, maiming and killing law-abiding citizens with
unmitigated impunity, yet the governor receives a monthly sum of N500 million in
“Security Votes” that he never accounts for. In November of 2021, a popular radio
presenter, Itiat Zion, was murdered in Calabar, the state capital, near the Governor’s
Office. And just like all other killings in the state, the governor refused to show any
willingness in apprehending these murderers. Meanwhile, please take notice that I did
not use the presenter’s case on the basis that his life was more important than others
who have been killed in similar circumstances. I simply used it as an example of
Ayade’s unwillingness to confront crime in Cross River State.
By the end of May 2022, Governor Ben Ayade would have received a total of N42 billion
in Security Votes in the event that the state is not owed any outstanding money in
respect of this. He will receive an additional N6 billion before leaving in May of 2023.
The question therefore is: why is it that Cross Riverians are not safe on their own soil
despite the receipt of this huge amount for security?
Defenders of Ben Ayade’s calamitous failure are quick to justify the governor’s
ineptitude on the basis that security is a challenge elsewhere in Nigeria, but such
defence is weak and is a further confirmation of the governor’s abysmal reign – a
governor who is only inspired by failure and not success.
The fundamental problem is that Nigerian citizens do not demand hygiene from those
jostling to represent them at every political level, which is why individuals such as Ben
Ayade and other conventional politicians whose disastrous performances at different
political spheres are well-known, have the temerity to declare their intentions to occupy
the highest political office in Nigeria to commit untold atrocities more than they already
have!
Ayade’s aspiration to become a minister in the next political dispensation should worry
anyone who is knowledgeable about his lamentable performance in Cross River State.
A governor who, for seven years and counting, refused to fix broken school structures
with open roof, deplorable roads and healthcare facilities, and whose colourful promises
were only actualised in the metaphysical world, will inflict boundless agony on Nigerians
through any ministry he occupies. The very thought of it terrifies me!

Dorsey, Musk, Buhari And Twitter By Ozodinukwe Okenwa

Twitter, Instagram and Facebook facilitate our daily digital interactions among friends and relatives, far and near. Cross-fertilisation of ideas remains a democratic imperative in a free world. The Internet, without any iota of doubt, has dramatically changed our communal or individual conversations among ourselves in the whole world. With the advent of the Internet freedom of expression has been given another profound meaning lifting same from the puritanical shackles of state censorship and dictatorship.
Dictators may not be happy with its unlimited reach and impact but it has come to stay for good. The Internet had helped to organize revolutions that successfully toppled authoritarian regimes. It has helped folks to demand accountability from the government. It has revolutionalized our daily existence.
The former Twitter proprietor, Jack Dorsey and Mark Zuckerberg of Facebook are billionaires who made name and good money for themselves by the force of revolutionary thinking and innovation. Though we have other billionaires (including the Africa's richest man, Nigeria's Aliko Dangote) who made fortune outside the world wide web network there is something infinitely beautiful about the Internet worth celebrating.
The advent of the Internet has made our world a better place to live in. But on the other hand it has demonstrated its capacity for nuisance, a vital tool for criminal elements out to destroy values and morals hitherto held dear.


In Nigeria Twitter is controversial as the Buhari regime tries to control its content or the amount of freedom it offers. Last year or thereabout President Muhammadu Buhari had banned Twitter in Nigeria following his 'genocidal' tweet against Igbos that the management had to pull down. Buhari angrily wielded the big stick damning the consequences. Many young Nigerians making money through Twitter were shut out.
Now, Twitter is back following the so-called agreement reached with the US-based network. The Buhari dictatorial regime is accused rightly by critics of being insensitive to the economic plight of Nigerians. By banning twitter for many months just like the way he closed our land borders for years he never gave any thought about the welfare and employment of thousands of our compatriots.
Instead of creating employment Buhari and his handlers had sought to shrink the public space destroying means of livelihood of citizens. As thousands of more graduates roam the streets in search of elusive employment many among them are using Twitter in particular and Internet in general to make ends meet.
Twitter recently changed ownership. The richest man in the world (born in Pretoria, South Africa in 1971) Elon Musk, has acquired Twitter for a staggering 44 billion Dollars! The SpaceX business mogul is said to be worth an estimated US$252 billion, a stupendous amount in the hands of an individual! That whooping amount of money represents less than the entire Gross Domestic Product of the giant of Africa, Nigeria, whose GDP is estimated to be a little above four hundred billion Dollars.
Announcing the deal enthusiastically Musk declared that "Free speech is the bedrock of a functioning democracy, and Twitter is the digital town square where matters vital to the future of humanity are debated".
For Musk buying over Twitter could be said to be a good investment for the present and the future. And for the former proprietor, Jack Dorsey, it is the right thing to do at the right time since the price is right. Dorsey was emotional when he spoke about the mega business deal that saw him billions of Dollars richer.
But beyond what he stands to gain he spoke passionately about what Twitter represented and why Musk is the right man for proprietorship. He made it clear that the idea behind Twitter was for the public good arguing that Musk had promised to deepen the Twitter potentials guaranteeing the free flow of information and ideas.
Musk also declared his ambition of making the popular micro-blogging website a better tool for the propagation of liberty and free expression everywhere. He hammered on the need for Twitter to witness more liberalization removing censorship or sanction of whatever hue.
That means that under his command Twitter would see more frontiers of freedom opened up and more tolerance of dissent or divergent views.
But some concerned cyber experts and critics are warning about the 'anything-goes' regime on Twitter. They reason (and we concur) that allowing unfettered access to the global network brand could defeat the objectives and essence of freedom of expression or unlimited conversation.
Indeed, the fears expressed are real! While cyber fraud is a global phenomenon dating back decades terrorists, kidnappers, cyberstalkers, blackmailers and merchants of contraband goods and services could exploit any liberal loophole existing on Twitter to propagate hate speech, religious intolerance and/or making of illicit funds.
There must, therefore, be a balancing act to be executed in order to make Twitter answer to the needs of millions. A balance must be struck inbetween what is allowed and otherwise.
Twitter remains for good of humanity but it could serve as a destructive weapon against the global order if certain mechanism for checks and balances are not spelt out and incorporated.
While we recognise that the Internet is a revolutionary idea whose time has come in our generation the devil in the detail must be exposed and accounted for. Abuse must be watched out for and sanctioned. Cyber security must be a priority in a world where evil is manifestly rampant.
Let the decent tweeting continue unabated! Together we shall conquer evil.

Nigerian Government Declares Monday, Tuesday As Public Holidays

The Nigerian government has declared Monday, May 2 and Tuesday, May 3 as public holidays to mark the Workers’ Day and Eld-el-Fitr celebrations.
This was announced on Thursday by the Minister of Interior, Rauf Aregbesola, according to a statement by the Ministry’s Permanent Secretary, Shuaib Belgore.

Aregbesola commended workers for their hard work, diligence, and sacrifice, noting that their efforts are largely responsible for the greatness of the country.
The statement partly read “Labour is the very essence of humanity. We are alive because we work and only the dead are incapable of working.
“I, therefore, enjoin workers to imbibe the culture of productivity. Workers are also urged to raise the bar of their trade-in line with the President, Major General Muhammadu Buhari (retired) led administration’s drive to rev up the vehicle of governance and make all the people of Nigeria derive maximum benefit from the nation. The end of work is productivity. It is productivity that leads to the satisfactory provision of goods and services and wealth creation. It is therefore the path to national and individual prosperity.”
He further congratulated all Muslims on the successful completion of the holy month of Ramadan.
He, however, urged the Muslim faithful to imbibe and practice the virtues of kindness, love, tolerance, peace, self-denial, sacrifice, and good neighbourliness, as exemplified by the Holy Prophet Muhammad.
“The minister expresses confidence that the security challenges in some parts of the country will soon be a thing of the past, noting that the government is putting determined efforts and all necessary measures in place for Nigerians to enjoy unfettered peace all around.
“Aregbesola assured Nigerians that the Buhari’s regime was fully committed to the security of life and property of every citizen and foreigners alike, urging Nigerians to be part of the nation’s security architecture by being vigilant and reporting suspicious individuals and activities to law enforcement agencies.”

I Didn’t Ask Senate To Remove Contentious Section 84 (12) From Electoral Act – Buhari Tells Court

President Muhammadu Buhari on Thursday told a Federal High Court in Abuja that he did not order the Senate to remove the contentious Section 84 (12) from the amended Electoral Act 2022.
Contrary to the claims of the Peoples Democratic Party (PDP) in a suit instituted against him and 12 others on the Electoral Act, Buhari said that he only expressed reservations and concerns in respect of the aspect of the Electoral Act.


The president’s position was contained in a counter-affidavit filed at the Federal High Court at the instance of the Attorney General of the Federation and Minister of Justice, Abubakar Malami.
In the joint counter-affidavit by Buhari and Malami to debunk PDP’S claims in the suit, the AGF explained that Buhari on February 25, 2022, gave proper, full and unconditional assent to the amended Electoral Act.
The counter-affidavit by the President and Malami, according to Daily Post, was filed on their authority by a Senior Advocate of Nigeria SAN, Oladipupo Okpeseyi, and deposed to by Abimbola Akintola, a legal practitioner.
Buhari and Malami averred that the claims of PDP in its suit against them on the Electoral Act were false and replete with gross untruths aimed at misleading the court to give judgment against them.
The counter affidavit read in part, “The assent of the 1st defendant (Buhari) to the Electoral Bill given on February 25, 2022 was proper, full and unconditional.
“The 1st defendant (Buhari) assented to the Electoral Bill 2022 on February 25 but did not give conditions or directives to the National Assembly in the manner erroneously deposed to by the plaintiff (PDP).
“At no time did the 1st defendant (Buhari) give any directive to the management or leadership of the National Assembly as regards the removal of section 84 (12) of the Electoral Act 2022; from the Act.
“Prior to assenting to the Electoral Bill 2022, the 1st defendant (Buhari) merely expressed his observations and concerns about the constraints of section 84 (12) of the Bill on serving public office holders and political appointees but gave his assent to avoid further delay as time was of essence.
“That the 1st defendant (Buhari) merely expressed his views not only to the National Assembly but to the entire nation as regards the inconsistency of section 84 (12) of the Electoral Act with other provisions of the Constitution.
“On March 8, 2022, 1st defendant (Buhari) officially wrote the Senate President and House of Representatives Speaker to express his concerns about section 84 (12) of the Electoral Act and formally requested for amendment to be effected on the section so as to eliminate areas of infarction with the Constitution.
“I’m aware that the National Assembly neither accepted nor acted on the opinion or suggestion of Buhari.
“In this instance, 1st and 2nd defendant, (Buhari and Malami) truly and firmly believe that section 84 (12) of the Electoral Act disenfranchises and discriminates against Nigerians in public service or public office holders who are political appointees and prevent them from engaging in the electoral process in exercise of their inalienable rights in a participatory democracy.
“That Buhari and Malami have never taken it upon themselves to declare section 84 (12) or any provisions of the Electoral Act unconstitutional as such is beyond their constitutional power.”
Justice Inyang Eden Ekwo of the Federal High Court in Abuja had on March 7 stopped Buhari, AGF and Senate President from tampering with the newly amended Electoral Act 2022.
The judge in a ruling on an ex-parte application by the Peoples Democratic Party, PDP, agreed that the Electoral Act having been assented to by Buhari had become a valid law and could not be tampered with without following due process of law.
Justice Ekwo agreed with Chief James Ogwu Onoja SAN, counsel to PDP, that the proper place to challenge the validity of any existing law or the Electoral Act is a court of competent jurisdiction.

Nigerian Labour Congress To Go On Strike Over Buhari Government’s Failure To Agree With University Lecturers, ASUU

The Nigeria Labour Congress (NLC) has threatened to embark on a three-day nationwide warning strike if the Federal Government continues to ignore the demands of the Academic Staff Union of Universities (ASUU).
NLC also said it would hold a national protest within the 21-day ultimatum to the Nigerian government.


The government has in the last 73 days failed to reach a deal with the public university lecturers.
ASUU had on February 14 embarked on strike over poor pay, years of unmet agreements and deplorable service conditions.
NLC President, Ayubba Wabba in a pre-May Day rally in Abuja on Wednesday said the association would embark on a three-day nationwide warning strike in solidarity with the three – universities based unions: Non-Academic Staff Union of Educational and Associated Institutions (NASU), Senior Staff Association of Nigeria Universities (SSANU) and National Association of Academic Technologists (NAAT).
He said, “Within the span of the subsisting 21-days ultimatum given by Congress, the NLC will hold national protests against the current strike action affecting students of Nigeria’s public universities and occasioned by government’s failure to honour agreement reached with trade unions in our universities.
“The protest is to draw the attention of government to the inherent catastrophe in the emerging culture of Social Apartheid in our society especially as marked by prolonged lockout of students from working class and poor homes from our public universities while the children of the rich continue their academic pursuits uninterrupted.
“If at the end of the national protest and the 21-days ultimatum, the Federal Government still fails to resolve the industrial crises in Nigeria’s universities, the Congress would be left with no other option than to embark on a 3-days nationwide warning strike action in solidarity with our affiliates in the universities and with Nigerian students whose future and wellbeing are being robbed.”

Cultists Disrupt Governor Soludo’s Meeting In Anambra, Attack 60-year-old Activist

A meeting that was scheduled to be held between the Anambra State Governor, Prof Chukwuma Soludo, and tricycle operators has been disrupted by gunmen suspected cultists.
It was learnt that the incident where the cultists wielded guns and other dangerous weapons happened at the Alex Ekwueme Square, Awka on Thursday.


According to Punch, the tricycle operators had gathered to thank the governor for the bold step he took in stamping out touting and all forms of illegal revenue collections as well as to notify him of the latest development in that sector since he announced the decision to stop touting in the state.
"The hoodlums targeted a human rights activist, Osita Obi, who had been at the forefront of the fight to rid the state of touts," the source said.
It took the intervention of the police officers from the B Division, Awka to rescue the 60-year-old activist.
An eyewitness said, “The Keke drivers were waiting patiently at the Ekwueme Square for the arrival of the governor to thank him for the bold step he took to stamp out touting and all forms of illegal revenue collections as well as to intimate him with the goings-on in the field barely one month he took the decision to fight touting to a standstill in Anambra State.
“They had all assembled when suddenly two tricycles loaded with about 11 armed thugs invaded the venue, identified the said Comrade Osita Obi, and pounced on him, beating him mercilessly until the police operatives from B Division Awka came just in time; shooting in the air and rescuing the activist from the hoodlums.
“The hoodlums were sent to disrupt the governor’s interface with the Keke drivers.”
Speaking with Punch on his hospital bed at the emergency unit of the Chukwumeka Odumegwu-Ojukwu University Teaching Hospital, Amaku Awka, Obi said if not for the timely intervention of the police, he would have been a dead man.
He said, “We were patiently waiting for the governor’s arrival when some armed young men descended on me and hit me with all kinds of weapons with the intention to kill me because I was supporting the governor’s decision to end all manners of illegal revenue collections, especially from Keke drivers.
“We gathered at the Ekwueme Square to thank the governor for removing touts and cultists from Keke operation and also to give him feedback on what is happening in the field. So, not long, one Collins Ozojiofor, alias Snoop, came with some boys to attack me.
“They stole my phone, my eye glasses and stole the N50,000 I had on me. They beat me mercilessly. You can see my swollen face. I have pains all over me. Their mission was to kill me. Some of the Keke drivers alerted the Police Public Relations Officer who now called the DPO of B Division and they came there and rescued me and took all of us to the police headquarters.
“There at the police headquarters, while we were waiting for the commissioner to come and talk to us, I fainted. That was how I was rushed first to the Government House clinic, because I wanted the government to be aware of what we are doing. So, the Chief Protocol Officer directed that I should go to the Commissioner for Health who also directed that I should come to the emergency unit here.”
He said the fight against illegal revenue collections was not Soludo’s fight alone. He said citizens ought to support him with feedback.

BREAKING: Nigerian Copyright Commission Starts Criminal Investigation Into Airtel's Alleged Unauthorised Use Of Veno Mbanefo's Hit Song

The Nigerian Copyright Commission has launched a criminal investigation into an allegation by a veteran artiste, Veno Marioghae Mbanefo that a telecommunications company, Airtel Network Limited used her song, ‘Nigeria Go Survive’ to promote its TV app and ‘The Voice Nigeria’, without her permission.
Mbanefo, in a letter, addressed to the company by her lawyers asked the telecoms company to “cease and desist forthwith from further infringing on the copyright of our Client to the aforementioned musical work”.


It also asked Airtel to “pay to our Client the sum of N50, 000,000 (Fifty Million Naira) for the unauthorised commercial and also derogatory use of her musical work”. 
Reacting in a letter signed by Joachim Okere and Adebayo Ajayi, the head of legal services and lead, Litigation and Dispute Management respectively, Airtel Nigeria denied the claims which it described as 'false and defamatory'.
The telecoms company said it had not promoted its TV App with Mbanefo's musical work. 
The company further demanded a letter of retraction/apology from Mbanefo within seven days from the receipt of this letter or risk civil/criminal legal actions instituted against her.
However, the artiste has insisted on the copyright infringement suit and her demand of N50 million compensation.
SaharaReporters learnt on Thursday that the Nigerian Copyright Commission had commenced an investigation into the claim. 
"NCC has commenced criminal investigation now. Veno Marioghae Mbanefo has written her statement today. Criminal investigation has commenced against Airtel," a source told SaharaReporters on Thursday. 
 
A letter from Mbanefo's lawyers addressed to the Director-General of the Nigerian Copyright Commission (NCC), urged the Commission to invoke its investigative and prosecutorial powers under the Nigerian Copyright Act to protect its client and ensure that violators of her copyright are duly sanctioned accordingly.
The letter signed by Felix Igelige reads, “We are solicitors to Veno Marioghae Mbanefo (our Client), a musician and entertainer residing in Lagos and we write this letter on her behalf.
“Our Client is the author and copyright owner of the musical work entitled “Nigeria Go Survive” being used by Airtel Network Limited (Airtel) to promote their TV app, "The Voice Nigeria” and other of their products.
“As you are aware, our Client has a number of exclusive rights defined by the Copyright Act, Cap 28, Laws of the Federation of Nigeria, 2004. 
“These include the right to reproduce the works, and to publish and communicate same to the public (including by way of sale and broadcast, both conventionally and online or via the Internet).
“It is an infringement of copyright to do any of these and other protected acts in relation to the whole or a substantial part of a copyright work, or to authorize anyone to do such an act or acts on your behalf, without the permission or licence of the copyright owner.
“Our Client’s attention has been drawn to the use, without permission or licence, of her aforementioned musical work by Airtel Network Limited (Airtel) for telemarketing. 
“Specifically, Airtel Network Limited (Airtel) has appropriated the said work to promote their TV app, "The Voice Nigeria" and other of their products without obtaining our Client’s prior permission or licence before engaging repeatedly in this act or acts.
“Their conduct is a flagrant and deliberate infringement of our client's copyright. It also amounts to stealing and wilful deprivation with the intent to unjustly enrich their company and deny our Client of the legitimate fruits of her labour, thereby inflicting hardship on our client.
“By this letter, our Client requests that you invoke the investigative and prosecutorial powers of the Commission under the Nigerian Copyright Act to protect her copyright and ensure that violators of her copyright are duly sanctioned accordingly.
“Our Client has all the necessary and relevant evidence that will aid the investigation of this matter. And she is willing and ready to make them available for use in the course of the investigation.
Attached is a flash drive containing some of the promo with her musical work been used by Airtel Network Limited for telemarketing.”
